With reference to previous correspondence, terminating with your despatch No.12 of the 14th January, 1936, on the subject of the Defence Contribution payable by the Colony of Hong Kong, I have the honour to ask that representations may be made to the Army Council with a view to the recognition of the Sand Monopoly as a new productive undertaking, assessable, in accordance with the terms of Section 3 (3) (i) of the Hong Kong

Defence Contribution Ordinance No.1 of 1901 as amended by Ordinance No.43 of 1935, on a net receipts basis.

Ordinance No. 50 of 1935, a copy of which is

enclosed gave in effect to the Government of Hong Kong the exclusive privilege of collecting, storing, and selling sand from beaches or unleased land in the Colony. The Ordinance is designed to prevent the theft of sand

from land, foreshore or sea-bed, not under lease from the Crown, and to control the importation and removal of sand by junk, lighter, truck or lorry. The Monopoly is a productive undertaking, and is entirely concerned

with sales to the public.
